CASE DETAILS:
The defendant was stopped after the police received a report from a concerned woman that described a suspicious vehicle that followed her from East Boston into Chelsea. During the seizure of the defendant, the officers learned from dispatch that a felony arrest warrant existed. The name listed on the warrant management system was substantially similar to the defendant, and the date of birth matched that of the defendant’s. Accordingly, the defendant was placed under arrest.
During the inventory search of the defendant and his vehicle, the investigating officers found a number of individually packages, glassine bags containing cocaine. Furthermore, the arrest took place within 1,000 feet of a school; thus, the defendant was charged with a school zone violation that carries a mandatory minimum sentence of two years of incarceration.
Defense counsel filed a motion to suppress evidence. Defense counsel challenged both the validity of the stop and the felony arrest warrant. During the evidentiary hearing, the criminal defense lawyer successfully persuaded the court that the Commonwealth failed to satisfy their burden of providing sufficient evidence that the arresting officers acted upon reasonable suspicion to affect a stop of the defendant’s motor vehicle. Accordingly, the court suppressed all evidence that was seized pursuant to the stop.
