Counterfeit Substances

Massachusetts General Laws Chapter 94C Section 32G makes it a crime to distribute, create, possess, or possess with intent to distribute counterfeit controlled substances. A counterfeit controlled substance is a substance that was represented to contain illegal drugs even though it didn’t really contain any illegal substance. In other words, counterfeit controlled substances are fake drugs. To be convicted of this crime, the prosecutor has to prove that the defendant acted intentionally or knowingly, and this is usually inferred from the circumstances.
