ILLEGAL POSSESSION OF A FIREARM – SALEM DISTRICT COURT
The police report stated that officers responded to a report of a gunshot victim that was being treated at the local emergency room. While speaking to the victim, officers suspected that he illegally possessed a loaded firearm. Still at the hospital, the investigating officers obtained incriminating statements from the suspect, and a signed consent form authorizing the investigating officers to search the suspect’s residence for the firearm. SURRENDER HEARING – PROBATION VIOLATION, CHARLESTOWN DISTRICT COURT
The Charlestown District Court issued a Warrant following an alleged violation of terms of probation in 1986. The defendant had entered into a probation contract, and agreed to participate in a sixteen week Alcohol Education Program. The Charlestown Department of Probation alleged that the defendant failed to attend the required program, and owed outstanding supervision fees related to the probation contract. MOTOR VEHICLE INFRACTION APPEAL
The defendant was issued a Massachusetts Uniform Citation because a Massachusetts State Trooper alleged that the defendant was travelling in excess of thirty four miles per hour above the posted speed limit. Accordingly, the defendant was assessed a $340 fine and faced the likelihood of the RMV suspending his Massachusetts license to operate a motor vehicle. The defendant filed an appeal, and was required to attend a Civil Motor Vehicle Infraction Hearing at Charlestown District Court s that a clerk magistrate could determine whether to assess the defendant the fine. The defendant’s wife notified the local police department that she believed her husband was involved in the sale of illegal narcotics. Detectives and additional members of the drug control unit maintained open channels of communication with the defendant’s wife, while they conducted a thorough investigation that involved informants and surveillance of the defendant. DRUG TRAFFICKING TRIAL REPORT QUINCY
The defendant was travelling on Interstate 93 in Quincy, when the Massachusetts State Police affected a traffic stop. The Trooper cited excessive window tint and a malfunctioning rear light, in justification of the initial stop of the vehicle. The Trooper further alleged that the defendant’s vehicle contained multiple air fresheners, multiple cellular phones and that the defendant began to sweat and act nervously during the threshold questioning. The Jamaica Plain Drug Control Unit, in conjunction with additional members of the Boston Police Department, after conducting a comprehensive investigation of a suspected Illegal Drug Distribution Ring, applied for and executed multiple search warrants at target addresses in Roxbury and West Roxbury. DRUG POSSESSION WITH INTENT TO DISTRIBUTE
The defendant was stopped after the police received a report from a concerned woman that described a suspicious vehicle that followed her from East Boston into Chelsea. During the seizure of the defendant, the officers learned from dispatch that a felony arrest warrant existed. The name listed on the warrant management system was substantially similar to the defendant, and the date of birth matched that of the defendant’s. Accordingly, the defendant was placed under arrest. Defendant was the subject of a state police motor vehicle stop at a sobriety checkpoint on Soldier’s Field Road in Brighton, Massachusetts. AMESBURY SECOND OFFENSE OUI
Defendant was the subject of a motor vehicle stop by the Amesbury Police Department. The police alleged that the defendant was operating with her high beams on and failed to dim them even after being signaled to do so by an oncoming police cruiser. The officer further alleged that the defendant seemed to be unaware that her high beams were on even after she was stopped. Defendant, who had two prior convictions for OUI, was alleged to have swerved over the marked lane into the oncoming path of a police cruiser, forcing the cruiser off the side of the road. The arresting officer testified that he stopped the defendant, who was unable to locate the vehicle registration. The officer determined that his speech was slow, deliberate and slurred and that he smelled of alcohol.
