CASE DETAILS:
Defendant was unaware that substance she was carrying was a controlled substance. Police used a confidential informant to contact the target and make a series of controlled buys and she was found with cocaine on her person. As a result over 10 grams of cocaine was seized. Defense successfully argued that defendant, a poor and uneducated Colombian citizen was unaware of the fact that the substance she was ingesting herself and was distributing to the informant was cocaine. Defense argued that unsuspecting defendant was preyed upon by the government informant. The defendant was a single working mother complaining of being overly fatigued. The defendant claimed that the informant introduced this substance to her as a lawful home remedy to overcome her fatigue.
