Drug Trafficking Trial Report, Boston

DRUG TRAFFICKING – BOSTON MUNICIPAL COURT ROXBURY DIVISION

CRIMINAL CHARGES ALLEGED:

  1. Trafficking in Heroin; more than 28 grams
  2. Trafficking in Heroin in a School Zone
  3. Possession of Cocaine with the Intent to Distribute
  4. Possession of Cocaine with the Intent to Distribute in a School Zone

CASE DETAILS:

The Jamaica Plain Drug Control Unit, in conjunction with additional members of the Boston Police Department, after conducting a comprehensive investigation of a suspected Illegal Drug Distribution Ring, applied for and executed multiple search warrants at target addresses in Roxbury and West Roxbury. Additionally, the police executed arrest warrants for suspected participants in the alleged Drug Ring that was believed to be Trafficking in Heroin and Cocaine in the West Roxbury and Roxbury areas.

The police investigation spanned more than six months, and involved extensive police surveillance and the utilization of confidential informants that conducted controlled purchases of narcotics from suspects. The defendant resided at one of the residential addresses that were targeted by police, and was present when the investigating officers executed a search warrant at the premises. The search of the defendant’s residence produced large quantities of Heroin, Cocaine and additional drug paraphernalia.

At the Defendant’s Arraignment at Roxbury District Court, the Criminal Defense Lawyer aggressively challenged the searches and seizures that lead to the discovery of incriminating evidence to be used against the Defendant, and secured the Defendant’s release on Personal Recognizance. Next, the Criminal Defense Lawyer filed a Motion to Disclose the Identity of the Confidential Informant; and, a Motion to Dismiss the charges against the Defendant. The Criminal Defense Lawyer successfully argued that the Commonwealth of Massachusetts failed to introduce sufficient evidence linking the Defendant to the crimes charged.

CASE RESULTS:

The Commonwealth of Massachusetts could not produce the identity of the Confidential Informant. Before the Roxbury District Court ruled on the Motion to Dismiss filed by the Criminal Defense Lawyer, the Prosecutor agreed to proceed no further in the case against the Defendant and entered a Nolle Prosequi. Accordingly, the charges were dismissed prior to trial.
