CASE DETAILS:
The state police used information allegedly obtained from a confidential informant and obtained a search warrant which authorized a search of the defendant’s home. Execution of the search warrant resulted in the seizure of large quantities of heroin, cocaine and cash. The defendant was indicted for trafficking in cocaine and trafficking in heroin.
Prior to trial, the criminal defense lawyer filed a motion to suppress and argued that the search warrant was illegal information because allegedly obtained from a confidential informant and other police observations was insufficient to justify issuance of a search warrant. The criminal defense lawyer successfully argued that the defendant’s constitutional rights were violated. The court agreed with the argument presented by the criminal defense lawyer and ordered that all evidenced seized pursuant to the search warrant be suppressed. As a result of the court ordering that all of the evidence be suppressed, based on the criminal defense lawyer’s argument, the prosecution was left with no case and all charges were dismissed.
