Fraudulently Obtaining Possession of Controlled Substances

Massachusetts General Laws Chapter 94C Section 33 makes it a crime to fraudulently obtain possession of controlled substances. This crime basically involves forging or falsifying prescriptions or failing to disclose a material fact in order to get a controlled substance from a doctor. The prosecutor has to prove beyond a reasonable doubt that the defendant acted knowingly or intentionally. The penalty for this offense is imprisonment in state prison for up to four years or a fine of up to $20,000, or both the imprisonment and the fine.
