Inducing Minors to Distribute or Sell Drugs

Massachusetts General Laws Chapter 94C Section 32K makes it a felony to induce or help a minor (a person under the age of 18) to distribute, sell, make, keep, or possess with intent to distribute or sell drugs. If the prosecutor’s case is that the defendant used a minor to distribute drugs, he won’t even have to prove that the defendant actually knew that the person was under 18. In contrast, if the prosecutor’s case is that the defendant helped (abetted) a minor to distribute drugs, then he will have to prove that the defendant knew that the person was under 18, that there was an express or implied agreement between the defendant and the minor, and that the minor distributed drugs.

The penalty reflects the seriousness of this charge, with the statute carrying a mandatory minimum sentence of 5 years in state prison.
