Pursuant to Massachusetts Drunk Driving laws, statutory license suspension exists when an individual suspected of OUI refuses or fails to take a breathalyzer test during their booking procedure at the police station.
The License Suspension Periods for Breathalyzer Test Failure are as follows:
Age 21 years and older: | |
If no prior OUI offenses – | 180 days |
If 1 prior OUI offense – | 3 years |
If 2 prior OUI offenses – | 5 years |
If 4 or more prior OUI offenses – | lifetime |
Age 18 years to 21 years: | |
If no prior OUI offenses – | 3 years + 180 days |
If 1 prior OUI offense – | 3 years + 180 days |
If 2 prior OUI offenses – | 5 years + 180 days |
If 3 or more prior OUI offenses – | lifetime |
Under Age of 18 years: | |
If no prior OUI offenses – | 3 years + 1 year |
If 1 prior OUI offense – | 3 years + 1 year |
If 2 prior OUI offenses – | 5 years + 1 year |
