Drug Trafficking Trial Report, Quincy

DRUG TRAFFICKING

NORFOLK SUPERIOR COURT

CRIMINAL CHARGES ALLEGED:

1.  Trafficking in Cocaine; more than 100 grams

2.  Equipment Violation

3.  Possession of False/Stolen RMV Documents

4.  Illegal Window Tint

CASE DETAILS:

The defendant was travelling on Interstate 93 in Quincy, when the Massachusetts State Police affected a traffic stop.  The Trooper cited excessive window tint and a malfunctioning rear light, in justification of the initial stop of the vehicle.  The Trooper further alleged that the defendant’s vehicle contained multiple air fresheners, multiple cellular phones and that the defendant began to sweat and act nervously during the threshold questioning.  Accordingly, the Trooper ordered the defendant out of the vehicle, conducted a pat frisk and placed the defendant in the back of the police cruiser.

The Trooper asserted that the defendant consented to a search of the vehicle.  Acting pursuant to the alleged consent provided, the Trooper performed an intensive search of the defendant’s automobile culminating in the discovery of a hidden compartment under the passenger door that contained over 100 grams of cocaine, approximately $3,000 in United States Currency and a number of items that were allegedly used to mask the aroma emitted from the illegal substances contained therein.

The criminal defense lawyer filed a motion to suppress evidence.  Defense counsel successfully challenged the validity of the initial stop of the defendant’s vehicle.  Additionally, defense counsel challenged the validity of the consent allegedly provided by the defendant and the scope of the search conducted by the Trooper.

CASE RESULTS:

The Norfolk Superior Court allowed the defendant’s motion to suppress all of the evidence seized pursuant to the traffic stop.  Accordingly, the charges were dismissed prior to trial.
