SUFFOLK COUNTY SUPERIOR COURT, BOSTON
CRIMINAL DRUG CHARGES ALLEGED:
- Drug Trafficking in Heroin and Distribution of Heroin
CASE DETAILS:
The police used information allegedly obtained from a confidential Informant and began a narcotics investigation targeting the defendant. Police conducting surveillance of the defendant allegedly observed that he engaged in a number of drug transactions over several weeks. The police obtained a search warrant and conducted a search which resulted in the seizure of large quantities of heroin and cash, as well as other items relevant to the search.
Prior to trial, the Boston criminal defense lawyer filed a motion to suppress and argued that the search warrant failed to establish probable cause to believe that items related to heroin distribution would be found at the target premises.
Prior to trial, the Boston criminal defense lawyer filed a motion to suppress and argued that the search warrant failed to establish probable cause to believe that items related to heroin distribution would be found at the target premises. The criminal defense lawyer successfully argued that the defendant’s constitutional rights were violated. The court agreed with the argument presented by the criminal defense lawyer and ordered that all evidenced seized pursuant to the search warrant be suppressed. As a result of the court ordering that all of the evidence be suppressed, based on the criminal defense lawyer’s argument, the prosecution was left with no evidence to present at trial and all charges were dismissed.
