CASE DETAILS:
Defendant was the subject of an automobile stop that resulted in the State Police Department seizing incriminating evidence from both the defendant’s person and his automobile, including: a number of glassine baggies containing cocaine; a “12-pack” containing open beers; a loaded 9mm handgun that was not registered to the defendant or his passenger; and, the defendant’s passenger provided documents that the investigating officer believed to be false. The prosecution attempted to justify the stop of the defendant’s vehicle on the basis that the vehicle was equipped with a defective exhaust system that was emitting an unreasonably loud noise.
Defense counsel successfully challenged the legitimacy of the motor vehicle stop conducted upon the defendant, and any searches conducted thereafter. Further, defense counsel successfully argued that the initial motor vehicle stop was unlawful because it violated both of the constitutions of the United States and the Commonwealth of Massachusetts. The defense successfully utilized expert witnesses to challenge the basis for the stop of the vehicle.
