CASE DETAILS:
Defendant was allegedly observed by Police to be operating his motor vehicle, which on multiple occasions struck the curb to his right and overcorrected by crossing over the double yellow lines in the center of road. After being stopped defendant had difficulty in retrieving his license from his wallet. Defendant displayed a strong odor of alcohol, glassy eyes and thick slurred speech. When asked what time he thought it was the defendant responded with a time that was incorrect by approximately two hours. Defendant admitted to having consumed three or four beers and had wet stains on his clothing. The arresting police alleged the defendant was given field sobriety tests and failed the one-leg stand, a nine step walk and turn, and backwards countdown. Defendant was alleged to have made the statement. “I couldn’t do that test straight, never mind now.” After being placed under arrest the defendant was belligerent and yelled profanities at police. Defendant refused the breathalyzer and as a consequence received a six-month license suspension

This case was disposed upon a plea bargain. OUI Criminal Defense Attorney convinced the prosecutors to dismiss the OUI charge and on an admission to sufficient facts the defendant received a Continuance Without a Finding (CWOF) on the charge of operating to endanger, thus insuring that the defendant’s criminal record remained free of any guilty finding. In addition, the registry immediately reinstated the defendant’s driver’s license. The operating to endanger charge was to be dismissed at the end of the period of the CWOF.
