CASE DETAILS:
Defendant was the subject of a state police motor vehicle stop at a sobriety checkpoint on Soldier’s Field Road in Brighton, Massachusetts. After the defendant was directed into the sobriety checkpoint, the investigating officer alleged that he smelled a strong odor of alcohol on the defendant’s breath, and found his eyes to be extremely bloodshot and glazed.
After instructing the defendant to exit his vehicle, the investigating officers administered a number of field sobriety tests upon the defendant. The officers alleged that the defendant failed to perform these tests in a satisfactory manner. Next, the police administered a portable breathalyzer on which the defendant registered a .10 score. The defendant was placed under arrest and submitted to an additional breathalyzer test. Again the defendant registered a score of .10, which was above the legal limit of .08.
