CASE DETAILS:
Defendant was alleged to be operating all over the road for several miles. Police stopped the defendant’s vehicle and alleged that he had difficulty opening his window, repeatedly activating the door lock instead of the window. Police alleged defendant exhibited an odor of alcohol, slow and slurred speech, denied having a drink – then later acknowledged he had been drinking – Police alleged that he was unsteady on his feet, using the hood of the vehicle to maintain a one leg stand or to complete a step heel to toe walk and turn test, tripping. The Police alleged that when he was placed under arrest he was argumentative at booking. He kept asking where his blue van was although he had been operating a blue Toyota Camry. The Police alleged that the defendant denied to police that he had been operating a Camry.
