CASE DETAILS:
Defendant was alleged to have been involved a “Road Rage” incident where he used his vehicle to chase another vehicle and repeatedly attempted to sideswipe the other vehicle, eventually forcing the other vehicle into lanes of oncoming traffic. Defendant proceeded onto interstate highway where he lost control of his vehicle, spun out of control and crashed in the median strip. Upon being approached by police, the defendant displayed a strong odor of alcohol, red and glassy eyes, slurred speech and admitted to having been drinking beer prior to the accident, although unable to say how many drinks he had consumed. Cans of beer, matching the brand which the defendant said he had consumed, were located on the ground next to the driver’s door of vehicle. Defendant was not arrested on the scene but was transported to the hospital via ambulance for medical treatment. The police subsequently mailed the defendant a citation charging him with Operating Under the Influence, Operating to Endanger, Assault By Means of a Dangerous Weapon and Marked Lanes Violation. In addition the police requested that the Registry of Motor Vehicles suspend the defendant’s driver’s license on the basis being an “immediate threat.”

OUI Criminal Lawyer Francis T. O’Brien Jr. filed a motion to dismiss in which he argued that the police did not follow proper statutory requirements with regard to the issuance of a criminal citation. The judge agreed with the argument of the criminal OUI defense lawyer and dismissed the case. In addition, the Registry reinstated the defendant’s driver’s license.
